    About a courtyard with many houses that open up into it, the Rabbis prohibited carrying from house to house until they create an eruv in which they have collected bread from each household and place it in one of the houses in the courtyard.     Laws of When the Eruv Becomes Invalidated After It Was Made — 5 Sections If an eruv was made and afterward became invalidated, and one of the courtyard residents comes to fix it again — if he comes to make the eruv from the same type of food as the first, even if the original is completely gone, he need not inform the others, and he may even make the eruv on their behalf using their food. If he comes to make it from a different type of food: if the original is completely gone, he must inform them if he is using their food, but if he is using his own he need not inform them at all. If the original has not completely gone but merely diminished, even if he is using their food he need not inform them.

    When One of the Courtyard Residents Leaves or Dies — 6 Sections One of the courtyard residents who left his house and went to spend Shabbat in another courtyard — even one adjacent to his own — if he put it out of his mind and does not intend to return to his house on Shabbat, he does not restrict them. This applies to a Jew, but a non-Jew — even if he went to spend Shabbat in another city — still restricts them until they rent his place from him, if it is within one day's journey, since it is possible he may come on Shabbat.     The laws of apartment partners regarding an Eruv. Containing 19 aragraphs: Roofs, courtyards, and enclosed yards are all considered one domain with respect to utensils that were in them when Shabbat began. It is therefore permitted to carry such items from one to another—even if they belong to different owners who did not join in an eruv. One may carry from one courtyard to another, to a roof, to the top of a wall between them, and from one roof to another adjacent roof—even if the other is much higher. One may also carry from a roof to a karpaf not larger than two se’ah, or one that was enclosed for dwelling even if larger, or to an alleyway (mavoy) that has been properly prepared with a side-post (lechi) or beam (korah), even if no eruv was made there. Even though the residents of a courtyard made an eruv among themselves—since household items are commonly found in the courtyard—it is nevertheless permitted to carry utensils that were in this courtyard at the onset of Shabbat to another courtyard, and we are not concerned lest one carry items that were in the house to another courtyard, roof, or karpaf.

    What things present in a courtyard do not restrict. Containing 4 sections A balcony that serves as a passageway to upper stories opening onto it, standing in the courtyard, accessed by a ladder, with the upper story residents descending from it to the courtyard and passing through to the public domain — they do not restrict the courtyard residents, since a ladder has the status of an opening, making it like two courtyards with an opening between them, where if they wish they may make a joint eruv and if they wish each may make their own eruv — provided all the balcony residents make their own eruv among themselves so that the permitted foot remains in its place.

    Laws of a pit and well between two courtyards. Containing 4 paragraphs A pit between two courtyards where there is no opening or window through which they could make a joint eruv — or where there is one but they did not make an eruv — one may not draw water from it on Shabbat unless a partition ten hand breadths high was constructed above the waterline. A hand breadth of the partition must descend into the water. If the entire partition is within the water, a hand breadth must protrude above the waterline so that one domain is visibly distinct from the other. Similarly, if a beam four hand breadths wide was placed across the mouth of the pit, one resident draws water from one side of the beam and the other from the opposite side. Rema: This applies specifically when one comes to draw with vessels from the house. But with courtyard vessels, no such arrangement is needed, since courtyards are considered a single domain, as stated above in Siman 372.

    Laws of courtyards that open into one another. Contains 5 sections Three courtyards opening into one another and opening to a public domain, where each of the outer ones made an eruv with the middle one but the outer ones did not make an eruv with each other — the outer ones are forbidden to each other, the middle one is permitted with each of them, and they are permitted with it. This applies when the middle one placed its eruv in one and its eruv in the other, or when the outer ones placed their eruv in the middle one in two separate houses. But if both outer ones placed their eruv in the middle one in one house, all three are permitted with one another.

    Laws of renouncing domain. Contains 4 paragraphs: One of the courtyard residents who forgot and did not make an eruv with the others restricts them. What is their remedy? He renounces his domain to them by saying "my domain is renounced to you" or "transferred to you," and no formal acquisition is required. He may renounce even after nightfall. If he lives with four or five others he must renounce to each one individually, saying "my domain is renounced to you and to you." Some say it suffices to say "my domain is renounced to all of you." If he renounced his domain without specification, he has only renounced his share in the courtyard — therefore they are permitted to carry from their houses to the courtyard, and he too is like a mere guest. But they are forbidden to carry from his house to the courtyard, and so is he. Some say he must lock his house so that he not come to carry out in a forbidden manner, and he should only open it when he wishes to enter or exit, locking it immediately after.

    Laws of one who renounced his domain and then carried anyway. Containing 7 paragraphs: One who renounced his domain and afterward carried from his house to the courtyard inadvertently does not restrict. If he did so deliberately he restricts, since he thereby retracts his renunciation. But if they had already taken possession meaning they carried from their houses to the courtyard or brought in from the courtyard to their houses he can no longer retract his renunciation. According to Rashi, taking possession is only effective if it occurred after nightfall.

    Whether a non-Jew's residence invalidates an eruv. Contains 20 sections One who lives with a non-Jew in a courtyard — the non-Jew does not restrict him until there are two Jews living in two houses who restrict each other, at which point the non-Jew restricts them. It does not help for the non-Jew to renounce his domain; rather they must rent from him. Rema: A Jew who rented or lent his house to a non-Jew does not restrict him, since he did not rent or lend it to him in order to restrict him. But if the house belongs to a non-Jew and a Jew rented it from him and the non-Jew lives in the house with him, the rental of the house does not help regarding the rental for the eruv. A Jew who lent or rented a house to his fellow in a place where non-Jews live — even if he has a hold in the house, it does not help and they must rent from the non-Jew.

    When the non-Jew is not in the house, he does not prevent [the eruv]. And it contains one paragraph. A non-Jew who lives with two Jews, when the non-Jew is not in his home, does not prohibit (see above, siman 371), and they may make an eruv and be permitted. If the non-Jew comes on Shabbat, he prohibits and the eruv is nullified. However, they can rent from him on Shabbat, and afterwards one can nullify his domain to the other, and the individual will be permitted. And all the more so, if the non-Jew died on Shabbat, one can nullify his domain to the other and the individual will be permitted.

Containing 9 paragraphs The Sages forbade carrying from courtyards into an alleyway, and permitted it through a partnership whereby bread or any other food is collected from each courtyard and placed in one of the courtyards, and we consider it as if the entire alleyway opens into that courtyard. Since this is only to create partnership among the courtyards, it may be placed in the airspace of the courtyard or in a house that is not four by four handbreadths, and need not be placed in a house — only in a protected place. Therefore it may not be placed in the airspace of the alleyway.

    Partners in an alley must make an eruv in the courtyards. containing 1 paragraph: Those who partner in an alley must make an eruv in their courtyards, so that children will not forget the law of eruv—since children are not aware of what is done in the alley. Therefore, if they partnered in the alley with bread, one may rely on it and they need not make an eruv in the courtyards, since children recognize bread. Some say that if each courtyard did not make an eruv for itself, one may not rely on the partnership. However, when each courtyard made an eruv for itself and afterward they partnered in the alley but did not make an eruv through the openings between them, they are permitted to use the courtyards in the alley through the openings between them, for one may rely on the partnership in place of an eruv. And if they made an eruv through the openings between them but did not partner in the alley, the courtyards are permitted to use the alley, for one may rely on the eruv that the courtyards made through the openings in place of partnership. Rama: Some say one may rely on partnership in place of eruv even if they only partnered with wine, and similarly one may rely on eruv in place of partnership. Above in siman 366 section 6 I wrote that our practice is initially to make only one partnership with flour. The reason is that our eruv, where each resident of the courtyard contributes to the partnership, constitutes both eruv and partnership together, and initially one should not do more. The requirement for both partnership and eruv was in Talmudic times, when courtyard residents did not contribute to the partnership; rather, the courtyard made an eruv together and one member contributed to the partnership. But in such a case everyone agrees that one only makes one partnership, and if one does more and recites a blessing on it, it is a blessing in vain.

A non-Jew who lives in an alleyway and has a back window of his house opening to a field or yard—even if it is only four by four handbreadths—does not prohibit the residents of the alleyway [from carrying], even if he brings in and takes out camels and wagons through the alleyway all day long. For he prefers the opening in back that is open to him alone, which has air, and his opening to the alleyway is as if he does not regularly use it, so he does not prohibit. This applies when the field or yard is more than two se'ah in area. But if it is only two se'ah, it is small and he is not satisfied with it. A Jew who has an opening to an alleyway and a back opening to a yard, and he forgot and did not make an eruv: if the yard is more than two se'ah, he prohibits, since it is not suitable for him and he does not withdraw from the alleyway.     Laws of nullifying permission for those who forgot to make an eruv. Containing 2 paragraphs: Just as the laws of nullification apply to one who forgot and did not establish an eruv in his courtyard, so too in an alleyway — if one courtyard forgot and did not join in the shituf, it may nullify its domain to the other residents of the alleyway, or they may nullify theirs to it, even though they are many. For the residents of a courtyard are considered as a single individual with respect to the alleyway. And just as the laws governing Jews dwelling in a courtyard with non-Jews apply, so too in an alleyway or in a walled city. Carrying is not prohibited in an alleyway or walled city unless there are two courtyards of Jewish homes in the city. But one courtyard alone does not suffice, even if many Jewish homes open into it.     Laws of City Eruvin. Containing 8 paragraphs: A city that has been the property of an individual, even if it became public- everyone can join in one partnership, and carry throughout the whole estate. Similarly, if it is publicly owned and it has one entrance- everyone can join in one partnership. But if it is publicly owned and and has two entrances, where the populace goes in one and out the other, even if the area came under private ownership, we may not make the whole thing into an Eruv. Rather, we must exclude a place, even as small as one courtyard and the house within it, from the city, and join the rest of the city together. Then all the participants in the partnership will be permitted in the whole city, except that one place that they excluded, and those residents remaining will be permitted in their own location, through a partnership they make for themselves. But if there are many residents remaining, it is forbidden to carry in the entire city. This is a provision instituted for the purpose of recognition, so that the residents will be aware that the Eruv has permitted them to carry in this place. The public becomes become expert on it, observing that we do not carry in the place that was excluded and not joined with them, but rather these carry in their own space and those carry in their own space. If residents wanted to institute an Eruv for each alley on its own, that would certainly be effective, for there is no greater exclusion than this.

    One does not make eruv chatzeirot (courtyard eruv) or shitufei mevoot (alleyway partnership) on a festival that falls on Friday. But if one forgot and did not make an eruv before the festival, and two festival days fall on Thursday and Friday, one may make an eruv on the festival conditionally, saying: "If today is a weekday, let this be an eruv; if today is holy, my words are nothing." And the next day one says: "If today is holy, I already made an eruv yesterday; if today is a weekday, let this be an eruv." This applies to the two festival days observed in the diaspora, but not to the two days of Rosh Hashanah, for they are considered like one long day. (See below, section 528.)

    A Person who was Sleeping while on a Journey [when the Shabbos Commenced] is Granted 2000 Cubits in All Directions [from the Place where He was Located]: One who sleeps on the way and darkness falls upon him, acquires a residence in his place and may traverse a distance of two thousand cubits in any direction. Specifically with regard to a person, because since if he had been awake, he would have acquired a place to sleep, he also acquires it while sleeping. However, ownerless objects do not acquire a residence, and they are like the legs of the first person to take them, who may take them to wherever he goes. However, objects belonging to non-Jews acquire a residence in their place, even though their owners are not considered residents. This ruling was made as a decree for non-Jewish objects, but Jewish objects are not subject to such a decree. And those who bring them [objects] into a city may move them within the entire city, which is like an area of four cubits, provided that the city is surrounded for dwelling purposes. Small, walled towns are considered to be surrounded for dwelling purposes, even if the houses were built first and the walls were erected around them later. However, it is necessary to make a partition at the end of the boundaries to separate them. Even if the partition is suspended and does not touch the ground of the ditch, it is still valid.     The laws governing whether the Shabbos limits applies ten hand breadths above [the Ground]: Concerning a person who walks more than 1o Tefachim outside the domain, such as jumping on top of ten-foot tall columns, and each one of them does not have a measurement of four hand breadths by four hand breadths, thus it is doubtful whether there are any areas above ten hand breadths or not. And when it is a Rabbinic law, its doubt will be resolved leniently. Rema: However, if one was walking on this path or by jumping there from within twelve cubits outside of twelve cubits, we follow the more stringent opinion, which states that the boundaries are twelve cubits according to Torah law (see my own words and Responsa of the Rambam). All authorities agree that the Scriptural prohibition [against going beyond] the Shabbos limits does not apply [to travel] on seas and rivers even [when one goes] beyond twelve mil, because do not resemble the encampment in the desert. When a person is traveling in a ship on Shabbos and arrives at a harbor [on that day], if [the ship] was always traveling ten handbreadths above seabed or riverbed from the commencement of the Shabbos until [the time when] the ship reached the harbor, [the person] is not considered [as one who] went beyond his Shabbos limits, and this person has 200o cubits from the place where he was lower than 10 tefachim. Rema: But if there is doubt whether it is above ten handbreadths or not, we follow the lenient opinion (see Ha-Maggid, Ch. 27). But if he has already gone two thousand cubits from the point where he landed downwards, he only has four cubits [of space to move] nevertheless, if he needs to leave the boat due to rain falling on him, or because the sun is shining on him, or because he needs to relieve himself, and because of these strong burdens he needs this [leniency] to enter the city, then he has the entire city as his four cubits. (this is the opinion of Al-Ashari, Mordechai, and the glosses of Asheri on Chapter "Mi She-Hotzi'o" [of the Talmudic tractate Shabbat].     Laws of placing an eruv and acquiring Shabbat rest. Contains 4 sections (It is permitted to make an eruv of boundaries and acquire Shabbat rest at the end of the boundary, and therefore:) One who left the city on Shabbat eve and placed two meals' worth of food at a distance from the city within the boundary and established his Shabbat rest there — even if he returned to the city and slept in his house — he is considered as if he spent Shabbat at the place where he placed the two meals. This is called an eruv of boundaries. He may walk from the place of his eruv the next day two thousand cubits in each direction. Therefore when he walks from his eruv two thousand cubits in the direction of the city, he may only walk within the city until the end of his measure. If the city is contained within his measure, the entire city counts as four cubits and he completes his measure beyond it. How so? If he placed his eruv one thousand cubits east of his house in the city, he may walk two thousand cubits east from his eruv, and two thousand cubits west from his eruv — one thousand from the eruv to his house and one thousand cubits from his house within the city — and he may only walk within the city until the end of that thousand. If from his house to the end of the city is less than a thousand — even by one cubit — so that his measure ends beyond the city, the entire city counts as four cubits and he may walk 996 cubits beyond it to complete the two thousand. Therefore if he placed his eruv two thousand cubits from his house in the city, he has lost the entire city and may walk from his house to the eruv two thousand cubits, but may not walk even one cubit from his house into the city in the western direction. Rema: Some say that even if his measure ends in the middle of the city he may walk through the entire city but not beyond it, and one may be lenient. And if his measure ends at the edge of the city, even though there is still an extension beyond the city, the entire city counts as four cubits — we do not say the city's extension counts as the city to be stringent. Wherever one places an eruv of boundaries and has two thousand cubits in each direction, he is only permitted to walk north and south within the width of the place where he acquired Shabbat rest. If it is only four cubits — such as when the eruv is not in a private domain — he may only walk in each direction two thousand cubits within the width of his four cubits and their corners, as explained above in Siman 398, section 2. Nevertheless, if his measure ends at the edge of the city and the entire city counts as his four cubits, he may walk its entire width and has two thousand cubits beyond the city to the north and south, even if he does not have that width opposite the place where he acquired the eruv.

    Laws of one who divides his eruv.     Laws of one who makes an eruv for many. Contains one section One who makes an eruv for many from his own food says "this eruv is for all the townspeople, and whoever wishes may rely on it" — provided it contains two meals' worth for each person. He must transfer ownership to them through another suitable person, as with eruv of courtyards (see above Siman 366, section 10), and he must inform them. Whoever he informed before Shabbat — even if that person did not resolve in his mind to rely on it while it was still day but only after nightfall — it is a valid eruv. But if he did not inform him before Shabbat, he cannot rely on it after nightfall. Similarly, one who placed an eruv for all the Shabbatot of the year and said "whichever one I choose I will go and rely on it" — even if he did not resolve in his mind until the next day, he may rely on it. Similarly, one who heard that a scholar was coming and did not know from which direction, and placed two eruvs and said "whichever direction the scholar comes from, that eruv shall take effect for me" — the eruv in the direction the scholar came from takes effect. Or if he said "if he does not come at all I will be like the townspeople," or "if two scholars come I will go wherever I wish" — everything follows his condition. Similarly, if he said to two or three people "I hereby make an eruv for whichever of you I choose" — even if he did not specify whom he chose until nightfall, it is a valid eruv.
